Attorneys’ Fees Required
July 8, 2014In this breach of settlement action, the plaintiff won almost $10,000 in damages, but the trial court awarded him zero dollars in attorneys’ fees. On appeal, the Court found that attorneys’ fees were proper under section 38.001(8), so the trial court had no discretion to deny them. The Court noted that one of the factors in determining the reasonableness of attorneys’ fees is the amount of damages awarded, and remanded the determination to the trial court.
