An Ex Parte Blunder
June 26, 2014Steadfast Insurance Company entered into an agreed judgment with appellants and later filed an application for turnover and appointment of a receiver in aid of judgment. Steadfast set its application for hearing but did not provide notice to appellants. At the ex parte hearing, Steadfast represented to the trial court that it had given appellants notice, and the trial court granted its application. Not surprisingly, the Court of Appeals set aside the turnover order and appointment of receiver for failure to provide notice.
