While affirming on the merits, the Fifth Court rejected an award of attorneys’ fees under Tex. R. Civ. P. 91a when the ground for dismissal was a lack of subject matter jurisdiction rather than the merits of a pleaded claim: “[N]o Texas case has ever awarded attorney’s fees under rule 91a.7 where the dismissal resulted from a lack of subject matter jurisdiction. In these circumstances rule 91a is not the ‘vehicle’ by which the case is disposed and, conversely, jurisdiction is not a ‘ground’ to which 91a is directed.” Dallas County Republican Party v.
