Sanctions motion ≠ TCPA

Barnes sued Kinser; in response, Kinser moved for sanctions. Barnes then moved to dismiss the sanctions request under the TCPA. The Fifth Court, citing a series of opinions involving analogous filings, held: “The request for sanctions here, like the similar request in Misko, is not a request for legal or equitable relief and not a legal action as defined by the TCPA.” Barnes v.
